Terms of Service
The terms that apply when you use this website.
1. About these terms
These terms apply to your use of the GenInteractive website. GenInteractive is the trading name of GENINTERACTIVE (PTY) LTD, a private company based in Durban Central, Durban, KwaZulu-Natal, South Africa. Company registration number: K2026876280. By using this website you agree to these terms.
2. Information on this website
The content of this website describes our services in general terms and is provided for information only. It is not an offer. The functionality available in any project depends on the requirements agreed with you.
3. Quotations and agreements
Sending an enquiry does not create a contract. Work begins only after a quotation or proposal has been agreed in writing. Scope and timelines will be set out in that agreement. An upfront deposit is required after the quotation and project agreement are accepted, with remaining payments arranged according to agreed project milestones.
4. Acceptable use
You agree not to misuse this website, including attempting to gain unauthorised access, sending spam or malicious content through the contact form, or interfering with its operation.
5. Intellectual property
The content, design and branding of this website belong to GenInteractive and may not be copied or reused without permission. Client-specific final deliverables transfer to the client after full payment, subject to the project agreement and third-party licensing terms. GenInteractive retains ownership of pre-existing and reusable tools, frameworks, libraries, templates and development resources unless otherwise agreed in writing.
6. Third-party links
This website may link to third-party websites. We are not responsible for their content or practices.
7. Disclaimer and limitation of liability
We take care to keep this website accurate and available, but we provide it "as is". To the extent permitted by law, GenInteractive is not liable for any loss arising from your use of, or inability to use, this website.
8. Governing law
These terms are governed by the laws of the Republic of South Africa.
9. Revisions, support and maintenance
Unless the project agreement says otherwise, two reasonable revision rounds apply to each agreed design or project milestone. Additional changes may incur additional fees. A 30-day period after handover applies to correcting defects within the agreed project scope; new features, changes and third-party issues are excluded. Hosting and ongoing maintenance are separate services unless explicitly included in the project agreement.
10. Changes
We may update these terms from time to time. The latest version will always be available on this page.
11. Contact
Questions about these terms can be submitted through our contact form or sent to us on WhatsApp (opens in a new tab).
